1. Subject of the Agreement
This agreement regulates the rights and obligations of the parties regarding the distance sale of olive oil and related products conducted via the website (oliveharmony.com.tr) by OliveHarmony.
2. Rights and Obligations of the Parties
2.1 Obligations of the Seller
- To deliver the ordered products to the specified address within the agreed timeframe, based on the selected payment and delivery method.
- To act in accordance with Law No. 4077 in cases where the product is defective, incomplete, or damaged upon delivery.
- To inform the consumer about distance sales and the right of withdrawal.
2.2 Obligations of the Buyer
- To provide accurate and up-to-date name, surname, address, and contact information during the order process.
- To fulfill the necessary cooperation and acceptance procedures during delivery.
3. Product Price and Payment
- Product prices are determined based on the current prices stated on the website and include VAT.
- Payment methods: Credit Card, Bank Transfer / EFT, Cash on Delivery.
- The seller processes the order after receiving payment.
4. Delivery and Transfer of Risk
- Products are delivered to the address provided by the buyer via cargo or courier.
- The seller is responsible for any damage or loss during delivery.
- Upon delivery, the responsibility for use and risk of the product transfers to the buyer.
5. Right of Withdrawal
The consumer has the right to withdraw from the contract within 14 days from the date of delivery, without providing any reason, in accordance with Law No. 4077 and the Regulation on Distance Contracts.
The right of withdrawal is valid only if the product is unused, undamaged, and in its original unopened packaging.
To exercise the right of withdrawal, the buyer must notify the seller in writing or via e-mail.
5.1 Returns in Case of Withdrawal
- The product must be returned to the seller complete and undamaged.
- After the return process is completed, the payment will be refunded within 14 days via the buyer’s preferred method.
- Return shipping costs are generally covered by the seller if the product is not defective; otherwise, they may be borne by the buyer if stated.
6. Termination and Cancellation
- Apart from the right of withdrawal, the agreement may be terminated by mutual consent of the parties.
- Returns are not accepted for products that have been opened and used after delivery.
7. Warranty and Defective Products
- Products are manufactured in compliance with TSE standards and the Turkish Food Codex.
- If the product is defective, the buyer must notify the seller within 10 days.
- The seller is obliged to resolve the issue through replacement, repair, or refund at no cost.
8. Dispute Resolution
- In case of disputes arising from this agreement, the parties shall first seek resolution through negotiation.
- In case of disagreement, consumer courts and arbitration committees shall have jurisdiction.
9. Enforcement
This agreement enters into force upon the buyer’s confirmation of the order.
Each provision of this agreement is valid within the framework of Law No. 4077 and relevant legislation.
